Monster Fishing Monthly Subscriber Draw Terms and Conditions

These terms and conditions (Terms) govern entry into the Monster Fishing Monthly Subscriber Giveaway (Promotion) run by Monster Merchants Online Limited, trading as Monster Fishing (Promoter, we, us, our). By subscribing to our email list or participating in the Promotion, entrants agree to be bound by these Terms and by the decisions of the Promoter, which are final and binding.

1. The Promotion

  1. The Promotion is a recurring monthly prize draw run by Monster Merchants Online Limited, trading as Monster Fishing, a company incorporated in New Zealand (NZBN: 9429052197260). Website: monsterfishing.co.nz.

2. Eligibility

  1. The Promotion is open to individuals who are legal residents of New Zealand or Australia and are 18 years of age or older at the time of the draw.
  2. Employees, contractors, and immediate family members of the Promoter and any agencies or suppliers directly associated with the Promotion are not eligible to enter.
  3. Entrants must be subscribed to the official Monster Fishing email mailing list with a valid, active email address at the time of the monthly draw.
  4. The Promoter may verify eligibility at any time and may disqualify any entry or subscriber it reasonably believes does not meet these conditions.

3. Promotional Period & Schedule

  1. The Promotion runs on a recurring monthly basis until terminated by the Promoter.
  2. Each monthly promotional period begins at 12:00am NZT on the 1st day of the calendar month and closes at 11:59pm NZT on the last day of that same calendar month (Monthly Entry Period).

4. How to Enter

  1. Automatic Entry: Active subscribers residing in New Zealand or Australia who remain subscribed to the Monster Fishing email list at the end of the Monthly Entry Period will automatically receive one (1) entry into that month’s draw.
  2. New Subscribers: Any eligible person who successfully subscribes to the Monster Fishing email newsletter during the Monthly Entry Period will automatically receive one (1) entry into that month's draw.
  3. Strictly one (1) entry per individual person / email address per month. Multiple subscriptions using temporary, secondary, or automated email addresses will result in disqualification.
  4. Unsubscribing from the email list before the draw date will automatically forfeit entry into that month's draw and any subsequent draws.

5. Monthly Prize

  1. On the 1st day of the following calendar month, one (1) winner will be selected for the preceding month's draw.
  2. The prize varies each month and will be selected at the sole discretion of Monster Fishing. The total retail value of each monthly prize pack will typically be up to or approximately NZD $250.00 / AUD $230.00.
  3. Specific monthly prize details will be announced via Monster Fishing's marketing channels (e.g., website, email newsletter, or social media).
  4. Prizes are not transferable, redeemable for cash, or exchangeable. If a prize (or part of a prize) becomes unavailable due to stock, shipping, or import restrictions, the Promoter reserves the right to substitute it with an item of equal or greater value.

6. Winner Selection & Notification

  1. The winner will be selected on the 1st day of the following calendar month by random draw from all eligible, active email subscribers across New Zealand and Australia.
  2. The winner will be notified by email within five (5) business days of the draw, using the email address registered on their subscription account.
  3. Claim Period: If the winner cannot be contacted, does not respond, or fails to provide a valid physical delivery address in New Zealand or Australia within 10 days of the first notification attempt, they forfeit the prize. The Promoter reserves the right to conduct a re-draw from the remaining eligible entries using the same random selection process.
  4. The Promoter's decision in relation to any aspect of the Promotion is final, and no correspondence will be entered into.
  5. With the winner’s consent, their first name, region, and country (e.g., "John S. from Queensland, AU" or "Sarah M. from Waikato, NZ") may be published in future email newsletters, on the Monster Fishing website, and/or on social media channels.

7. Delivery & Customs

  1. Prizes will be dispatched via trackable courier to a valid residential or commercial physical address in New Zealand or Australia at the Promoter's expense. PO Boxes may not be accepted depending on courier limitations.
  2. For Australian winners, Monster Fishing will cover standard delivery. However, the winner is responsible for any local import duties, taxes, or clearance fees should any apply under Australian customs regulations.

8. General Conditions

  1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who tampers with the entry process or engages in fraudulent or abusive conduct.
  2. The Promoter reserves the right to cancel, suspend, or modify the Promotion or these Terms at any time if fraud, technical failure, or any factor beyond its reasonable control impairs the integrity of the Promotion.
  3. To the extent permitted by law (including the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, and the Australian Consumer Law), the Promoter is not responsible for any technical failures, network outages, lost or misdirected emails, or any loss or damage arising from participation in the Promotion.

9. Privacy & Direct Marketing

  1. Personal information collected (name, email address, country, and delivery address if winning) is collected by the Promoter in accordance with the New Zealand Privacy Act 2020, the Australian Privacy Act 1988, and Monster Fishing’s Privacy Policy.
  2. By entering or remaining subscribed, entrants consent to receiving commercial email communications from Monster Fishing. Subscribers can opt out at any time using the "Unsubscribe" link included in every email. Opting out will remove the individual from future prize draws.

10. Governing Law

  1. These Terms and Conditions are governed by the laws of New Zealand, and entrants submit to the non-exclusive jurisdiction of the courts of New Zealand and Australia.
